Madrid, May 26. The Supreme Court (TS) has reduced the sentence of the two defendants who killed a young man in the Madrid town of Anchuelo in February 2020 from 18 to 14 years in prison, qualifying the crime as homicide instead of murder.
The events occurred on February 16, 2020 when the two defendants, Adolfo V. and Libertad M., accompanied by an unidentified third person, went to the house where Iván Toribio was staying with the intention of getting him to leave the home. that he lived in, in the same corrala, to be used by a family member.
There, the two convicts, “following the previously agreed plan”, entered the house -which belonged to some friends of the victim-, argued with the young man and attacked him “suddenly, surprisingly and without him being able to defend himself”. with two machetes that were hanging on the wall of the home.
With a machete with a 45-centimeter blade, Adolfo cut his head, while Libertad, with a curved machete, struck him at the level of the heart that caused significant bleeding and heart failure. He died half an hour later.
The Court of Madrid sentenced them to 18 years in prison for the crime of murder with treachery, a ruling that was ratified by the Superior Court of Justice of Madrid, but now the Criminal Chamber of the Supreme Court lowers their sentence to 14 years by qualifying the acts of homicide with the aggravating circumstance of abuse of superiority.
The Supreme Court says that “the fact that the defendants took the weapons that hung from the wall suddenly and unexpectedly does not meet the requirements that justify the aggravating circumstance of treachery”, so the crime goes from murder to homicide.
Now, that “Libertad and Adolfo, with the help of a third party, killed Iván in a scenario of advantageous superiority, which facilitated the ultimate execution of their purpose, cannot be questioned”, for this reason they add the aggravating circumstance of superiority.
Apart from the prison sentence, the sentence does confirm the payment of compensation of 340,000 euros to the victim’s relatives: 240,000 to the parents and 100,000 to the two brothers. EFE
