The legislators of European Parliament took a first step this Thursday towards the adoption of a law that regulate Artificial Intelligence (AI) tools, such as ChatGPT.
In a key vote in committees, MEPs overwhelmingly approved the position that calls for limit the excesses of AI in the European Union (EU). The text will be presented to the full parliament in June for adoption and, thereafter, negotiations will begin with the EU member states in order to agree on a final law.
They are a series of rules that were included in the artificial intelligence law which is being negotiated in Brussels and that the parliamentary commission approved by 84 votes in favour, seven against and twelve abstentions.
If these provisions are fully incorporated into the final law, the developers of these technological systems who want to introduce them to the market will have to demonstrate that they have reduced the risks that they may generate to health, fundamental rights and the democratic system and also submit to the analysis of independent experts.
In addition, the users of artificial intelligence systems that generate or manipulate videos, images or sounds that may mislead other people to think that they are authentic or true must inform the rest of the citizens that the content is false.
In addition, the creators of the technology will have to publish “a sufficiently detailed summary” about the copyrighted data they use to train artificial intelligence systems.
Likewise, the tools will have to be designed in such a way that throughout their useful life they have “appropriate levels” of performance, predictability, interpretability, correctability, security and cybersecurity.
“With these measures, we act strongly in the face of these challenges”, affirmed the rapporteur of the law, the Italian Social Democratic MEP Brando Benifei.
Beyond providing specific rules for these autonomous content generation systems, artificial intelligence law prohibits real-time mass surveillance systems in public spaces -except to prevent crimes and locate possible victims- and vetoes models that use subliminal techniques to “substantially” alter a person’s behavior, without them being aware of it.
In addition, it qualifies high risk to a whole series of artificial intelligence systems with very specific uses that can only be placed on the market if they respect the fundamental rights and values of the EU.
For example, those that can be used to influence the outcome of an electionthose used by financial institutions to assess the solvency and establish a person’s credit rating or those used by the border control police to control, monitor or process data to predict migratory movements.
The European Parliament wants companies that fail to comply with the regulations to be able to pay a fine of up to 7% of its worldwide annual turnover.
It is expected that the plenary European Parliament confirm its negotiating position for this rule next June and the Eurochamber will have to negotiate later with the European Comission and the Council of the EU the final text of the artificial intelligence law.
